TERMS AND CONDITIONS OF SALES

Unless otherwise arranged, 10% cash (non-refundable) with order, balance prior to shipment of machine.  Title does not pass until machine has been paid for in full.  There are no warranties by ACT Machinery as to compliance with any requirements of Federal, State and Local laws and industrial codes, including, without limitation, the Occupational Safety and Health Act of 1970 and all amendments thereto.  It is the buyer’s duty to inspect all machinery, to provide proper safety devices and equipment or means that may be necessary to safeguard the operator from harm and to safeguard each machine and equipment to meet all government standards, including the Occupational Safety and Health Act of 1970.  Specifications are approximate, not binding and meant as a guide only.  We reserve the right to correct typographical errors.  It is the purchaser’s responsibility to verify specifications and dimensions.  All machines offered subject to prior sale and for acceptance within ten days from date of quotation.  Prices subject to change without notice.  Orders are not subject to cancellation except by written mutual consent.  All equipment sold “AS IS” with no guarantees expressed or implied.  It is further understood and agreed this buyer or subsequent buyers will hold vendor harmless for causes of action whatsoever.  This agreement constitutes the entire contract of sale of the goods named herein.  No modification of this contract shall be binding upon Seller unless in writing and signed by an authorized officer of Seller.
